COMMISSIONER POWERS AND DUTIES: To conduct hearings for the purpose of reviewing disciplinary actions. Review is limited to suspensions, dismissals, and/or the demotion of employees covered by Civil Service under the Memphis City Charter. Commissioners have the power to administer oaths; subpoena and require the attendance of witnesses within the City of Memphis; have witnesses produce documents pertinent to the matters under review; and to examine said witnesses under oath in relation to matters under review. A Commissioner who is a licensed attorney, current or former judge, or person with prior experience as an administrative law judge for any local, state or federal agency is entitled to serve as a hearing officer. Hearing officers conduct hearings and may reverse or sustain the disciplinary action of the city. At least seven (7) of the Commissioners must be licensed attorneys, current or former judges and/or persons with prior experience as an administrative law judge for any local, state or federal agency. Each Commissioner is appointed by the City of Memphis Mayor. Commissioners will be appointed to either a one-year, two-year, or three-year term. The Mayor will designate one Commissioner to serve as chairperson of the Civil Service Commission. Each appointment must be approved by the Memphis City Council. Compensation and qualifications for Commissioners is set by ordinance. Pursuant to the Memphis City Charter, Commissioners are required to take an oath of office to uphold the Constitutions of the United States and of the State of Tennessee, and faithfully to discharge the duties of their respective offices neutrally and without bias. Compensation. The city council may establish by resolution, compensation for members of the civil service commission. Beginning on October 1, 2013, all commissioners shall be entitled to compensation for participation in any civil service hearing at the rate of $400.00 per full day and $200.00 per one-half day. Additionally, the commissioner charged with drafting the findings of fact and conclusions shall be entitled to an additional $100.00 in compensation.
