Location: Nebraska Emergency Management Agency, 2433 NW 24th Street, Lincoln NENOW HIRING: ATTORNEY WITH STRONG RESEARCH AND WRITING SKILLS - We're seeking an Attorney who excels at legal research, clear writing and interpreting complex laws. If we are unable to fill the position at the Attorney II level, we will consider applicants at the Attorney I level to be determined by education and/or experience. Upon a successful probationary period and all noted requirements and trainings are completed within one year and when performing higher level duties, the supervisor can recommend a promotion from Attorney I to Attorney II at a higher rate of pay. Job Duties: Confers with legal associates, agency staff, local government officials, and other interested parties to exchange and prepare information on the facts and status on legal and/or administrative actions or issues. Research legal precedents, case reports, and other legal documents to collect information for case preparation to facilitate the administration and enforcement requirements and needs of the agency. Guides technical support and/or legal staff in the legal practices and regulations of the agency to assist in the development of a competent, professional staff. Prepares legal documents for use by the Attorney General and/or County Attorneys’ offices in prosecuting civil or criminal cases. Presents information or testimony at public meetings or judicial or legislative hearings to provide and explain legal and policy information. Interprets provisions and advises agency staff and interested parties outside the agency regarding court decisions, administrative rules, and other legal statements to respond to inquiries form them to ensure adherence and compliance by agency staff. Drafts and analyzes proposed legislation, agency policies, and procedural statements to provide agency management with legal opinions and options. Represents the agency in administrative hearings related to the enforcement of federal and state statutes and/or administrative rules pertaining to the Agency. Lead strategy for risk assessment, compliance, and monitoring as necessary to comply with provisions of the Nebraska Emergency Management Act, Robert T. Stafford Disaster Relief and Emergency Assistance Act (Stafford Act), Title 2 and Title 44 of the Code of Federal Regulations and other relevant state and federal laws. Research and prepare drafts of Governor’s emergency proclamations, executive orders, and other official documents related to emergency declarations. Research and prepare Memorandums of Understanding, Memorandums of Agreement, contracts by and between the Agency, other state agencies, other political subdivisions, and federal entities. Represent the Agency on the National Emergency Management Association Legal Liaison Committee. Represent the Governor/ Agency in field deployments as the State liaison. Hourly pay rate range for the Attorney II is $29.395 - $43.331. Pay rate may be commensurate with education and experience if approved. Hourly pay rate range for the Attorney I is $25.433 - $37.491. Pay rate may be commensurate with education and experience if approved. Requirements / Qualifications:Minimum Qualifications: Attorney II: One year of experience as an attorney practicing law and providing legal services such as preparing cases, advising clients, and/or interpreting laws or administrative policies. Attorney I: Graduation from an accredited school of law and admission to the Nebraska Bar. Other: Background/motor vehicle request checks will be required prior to hire. Must have a valid driver's license. Legal Requirement: In accordance with Section 7-101, Nebraska Revised, Reissued Statutes of l 943, incumbents in this class must be admitted to the Nebraska Bar. Knowledge of the techniques of preparing/drafting legal documents and forms; the principles and practices of criminal and civil law administration; judicial procedures and rules of evidence; the principles and practices of legal research; the procedures of trial and administrative hearings. Skill in preparing summaries, legal analyses, findings, conclusions, briefs, and other legal documents; negotiating and communicating with others sufficient to persuade their acceptance of contentious goals or viewpoints.
